Korte Suprema, Nag-babala: Maaari Kang Makulong sa Pangangaliwa!




MATUTURING na isa sa pinaka-masakit na parte ng pag-aasawa para sa mga babae ang pangangaliwa ng kanilang mister. May mga babaeng hinahayaan na lamang ang sitwasyon dahil na rin sa kawalan ng sapat na pera o panahon upang sampahan ng kaso ang kanilang asawa. Ngunit may iilan din na inilalaban ang kaso hanggang Korte Suprema makakuha lamang ng hustisya.

Sa landmark ruling na inilabas ng Korte Suprema, maituturing na psychological violence ang pangangaliwa o pag-iwan ng isang lalaki sa asawa nito para sumama sa ibang babae.
Ito ay may kaugnayan sa kaso ng isang babae na inabot ng ilang taon sa paghahanap sa kanyang mister at huli nang natuklasan nito na nagsasama na ang kanyang mister at babae nito kasama ang kanilang tatlong anak.

Masasabing nakamit ng babae ang hustisya dahil sa desisyon ng Korte Suprema na pagkakakulong ng hanggang walong taon sa inirereklamong mister.

Sa ruling na inilabas noong Setyembre 8, sinabi ng Korte Suprema na isang uri ng psychological violence sa ilalim ng Republic Act 9262, o the Anti-Violence Against Women and Their Children Act of 2004 (VAWC) ang pag-iwan ng lalaki sa asawa nito para sumama sa ibang babae na nag-resulta ng emotional at mental suffering sa asawa.

Malinaw umano sa ilalim ng section 5 ng VAWC law na nagiging dahilan ito ng mental at emotional anguish.

Sa batas, kasama ang "pagtataksil sa pag-aasawa" sa listahan ng mga kilos na ikinokinsiderang  “psychological violence.”

Ngunit bago pa man maparusahan dahil marital infidelity, sinabi ng Korte Suprema na dapat matibay ang mga ebidensiya ng emotional anguish at mental suffering sa parte ng asawa.
Sa kasong isinampa ng asawa, napatunayan umano ng Las Piñas Regional Trial Court at Court of Appeals na napatunayan ito ng prosecution dahilan upang katigan ito ng Korte Suprema.

“Marital infidelity, which is a form of pyschological violence, is the proximate cause of AAA’s emotional anguish and mental suffering, to the point that even her health condition was adversely affected,” bahagi ng isinulat na desisyon ni Chief Justice Diosdado Peralta ng Supreme Court First Division.

Kasal umano ang mag-asawa mula noong 1989 at nagkaproblema nang na-assign sa Zamboanga ang lalaki para sa kanilang networking business noong 2007.

Sa testimonya ng asawa, nalaman nito ang pangangaliwa ayon na rin sa tip mula sa kaibigan ng kalaguyo ng kanyang mister. Nagpunta ito sa Zamboanga upang kumpirmahin na nagsasama na ang kanyang mister at babae nito. Nagdala din umano ito ng pulis upang ipa-aresto ang dalawa ngunit nahulog sa settlement ang kasong concubinage matapos nagkasundo ang lalaki at ang kalaguyo nitong hindi na ulit magkikita.

Ngunit dalawang buwan lamang umanong nanatili sa kanyang asawa ang lalaki at biglang umalis ng walang paalam.

Muli na naman itong hinanap ng asawa at humingi pa ng tulong sa National Bureau of Investigation o NBI. Nag-file din ang asawa ng petition for habeas corpus sa pag-aakalang hino-hostage ng kabit ang kanyang mister. Ito'y matapos nakatanggap ang asawa ng mga mensaheng may sakit ang lalaki at nangangailangan ng pera, at papatayin umano nito ang lalaki.

Na-dismiss naman ang nasabing petition noong 2014 matapos napatunayan ng NBI na kusang loob ang pagsama ng lalaki sa kanyang kabit at nagkaroon na sila ng tatlong anak.
Dahil sa nasabing rebelasyon, sinabi ng asawa na naging dahilan ito ng kanyang insomnia at asthma na nauwi sa pag-iinum nito ng mga anti-depressant at sleeping pills.

Ayon naman sa testimonya ng doktor, nagkaroon ng “depressed mood” at sleeping difficulty ang asawa mula sa labis na pamomroblema nito sa kanyang mister ngunit wala pa naman umano itong pyschiatric disorder.

Dagdag pa ng doktor na hindi matanggap ng asawa na hindi na ito ang nais makasama ng kanyang mister dahilan upang magkaroon ito ng insomnia, anxiety at depression.

“During the separation, there was no understanding of what had actually happened. And from her story that per 2007 until 2013, she was making an effort to actually find the husband and she was worried what was happening to the husband, it is enough to be the cause of emotional and psychological abuse,” bahagi ng testimonya ng doktor.

Sa ruling ng Korte Suprema, sinabi nito na hindi nire-require ng batas na maging psychologically ill ang biktima dahil sa psychological violence na ginawa sa kanya ng nangabuso.

“Rather, the law only requires emotional anguish and mental suffering to be proven. To establish emotional anguish or mental suffering, jurisprudence only requires that the testimony of the victim to be presented in court, as such experiences are personal to the party,” pahayag ng Korte Suprema.

Pinagbasehan ng Korte Suprema ang testimonya ng asawa na na-depress ito at laging nao-ospital, hindi makakain at makatulog hangga't masigurong buhay pa ang kanyang mister.
Sa pagtatanong ng Korte sa asawa kung ano ang gusto nitong mangyari, ito ang sagot ng babae:

“He must be put in jail so that he knows (sic) that he is really, he had done something wrong to me, because I love him so much, but then, he has different attitudes (sic) and he has a different answer against me (sic). I want to put him in jail, that’s all.”

Sa witness stand, inako ng babae na nasasaktan pa rin ito at hindi makalimutan ang mister dahil mahal niya pa rin ito. Ngunit inako din nito na hindi na siya kayang mahalin pa ng lalaki.

“I think no more, because until now, I know he doesn’t love me anymore because he wants to stay with another woman. So, I want him to be punished so that he will know how it feels to be hurt, both of them,” ang naging pahayag ng babae.

Sinubukan naman ng lalaki na itanggi ang mga alegasyon ngunit inako din na nagkaroon ng kabit at nagsasama sila simula pa noong 2008.

Dahil dito, pinatawan ng Korte Suprema ng hatol na pagkakakulong ang lalaki mula anim na buwan at isang araw hanggang walong taon at isang araw. Pinagbabayad din ito ng P100,000 na multa at moral damages na P25,000

Inutusan din ang lalaki na sumailalim sa mandatory psychological counseling o psychiatric treatment.

Pres. Duterte, Minamadali na ang Pagtatag ng OFW Department




MANILA — MULING ipinanawagan ni Pangulong Rodrigo Duterte sa Kongreso na madaliin na ang pagpasa ng panukalang batas na magtatatag ng Department of Overseas Filipino Workers o OFW.

Ayon sa pangulo, isa ito sa kanyang mga proposal noong panahon ng kampanya.
“I’d like to hurry up Congress on this one of my proposals during the campaign period was the creation of Overseas Filipino department,” pahayag ni Duterte.

Si Senator Bong Go ang naghain ng nasabing proposal sa Senado sa pamamagitan ng kanyang Senate Bill 202na may layuning magkaroon ng isang departamento para sa mga OFWs.

Ngunit ang nasabing panukala ay nananatiling pending sa Senate Labor Committee mula noong inihain ito noong Hulyo 2019 sa kabila ng mabilis na pag-aproba ng Mababang Kapulungan ng Kongreso.

Paliwanag naman ni Senate President Vicente Sotto III, naantala sa Senado ang panukalang batas dahil na rin sa mga isyung hindi pa napag-usapan. Ang nasabing mga isyu umano ay may kaugnayan sa Department of Labor and Employment (DOLE) at mga attached agencies nitong Philippine Overseas Employment Administration (POEA) at Overseas Workers Welfare Administration (OWWA).

Layunin din ng Senate Bill 202 na buwagin na ang POEA at OWWA kasama na ang tatlong iba pang ahensiya.

Ayon pa kay Sotto, malaking ahensiya ang planong itatag na Department of OFWs na siyang hahawak sa lahat na mga aktibidad ng mga OFWs. Dahil dito, hindi umano problema ang pag-absorb sa mga empleyado mula sa mga bubuwaging ahensiya.

“The bill’s advance at the upper chamber has been hampered by "issues (that) are yet to be settled. We are looking at the right-sizing bill in the Senate that needs to be finalized,” pahayag ni Sotto.

Sa kabila nito, hinihiling ni Duterte na madalin na ang pagpasa ng nasabing panukalang batas. Maliban sa OFW Department, sinabi din ng pangulo na nais din nito ng hiwalay na tanggapan na hahawak naman sa mga aktibidad ng mga seaman dahil umano sa napakaraming international laws.

Pangako ng pangulo sa mga migrant workers: “There will be a more thorough review on policy for your protection and that somebody should look after you.” 

Samantala, umaasa naman si DOLE Secretary Silvestre Bello III na hindi mabubuwag ang dalawang attached agencies ng ahensiya na nakatutuk sa mga OFWs sakaling maitatag na ang Department of OFWs.

“What I would like to happen is that agencies such as POEA and OWWA  will not be abolished. Let them be included in the department of OFW as attached agencies,” ang naging pahayag ni Bello.

Pinasiguro naman ni Bello na suportado nito ang planong pagtatag ng OFW Department.
“We support that. The President is right when he said that there should be a department that will solely look after the needs, welfare, and protection of our OFWs. A department that is fully dedicated to OFWs,” dagdag pa nito.

Swab Testing sa mga OFWs, Libre ayon sa OWWA



Isa sa mga ina-alala ng mga papauwing Overseas Filipino Workers o OFWs ngayong may panahon ng pandemya ay ang mga gastusin kasabay ng kanilang pag-uwi sa Pilipinas. Isa sa mga ito ay ang kanilang pagsasailalim sa ilang beses na Coronavirus disease o Covid-19 test bago pa man makarating sa kani-kanilang probinsiya.

Ngunit nilinaw ng Overseas Workers Welfare Administration (OWWA) sa mga papauwing OFWs na libre sa mga airports sa bansa ang swab testing para sa Covid-19.

Ayon kay OWWA Administrator Hans Leo Cacdac, libre ang swab test na isinasagawa sa airport ng mga Philippine Coast Guard. Libre din umano ang pagdadala ng mga specimen sa mga government laboratories at walang dapat bayaran ang mga OFWs na nasa airport para sa nasabing serbisyo.

“We want to emphasize that the swab test being conducted by the Philippine Coast Guard at the airport is free. The specimen being brought to government laboratories is also free. The OFWs who are there (airport) need not pay anything,” ang naging pahayag ni OWWA administrator Hans Leo Cacdac sa isinagawang virtual forum.

Pinayuhan na lamang ng opisyal ang mga uuwing OFWs na huwag tangkilikin ang mga nag-aalok ng swab testing sa airport na may kapalit na bayad.

Pinasiguro din nitong tinitingnan na ng Department of Labor and Employment (DOLE) at ng Department of Transportation (DOTr) ang nasabing isyu.

“As for my understanding, Secretary Silvestre Bello III and Secretary Art Tugade are currently talking to confirm this. We advised our OFWs not to engage the offer at the airport to pay for the test. But the situation is being looked at by Sec. Art Tugade,” ang dagdag na pahayag ni Cacdac.

Una rito, may lumalabas na report na pinapabayad ang mga umuuwing OFWs ng hanggang P20,000 para sa mabilisang Covid-19 test result.

Sa ngayon, may 5,200 pa umanong mga OFWs na nananatili sa mga hotel quarantine accomodation habang naghihintay ng kanilang swab result. Bahagi umano ang mga ito ng 6,000 na stranded Filipinos na naapektuhan ng isyu sa pagitan ng Philippine Health Insurance o Philhealth at ng Philippine Red Cross.

Samantala, inihayag naman ng Department of Health o DOH na hindi na kailangang dumaan pa sa coronavirus testing ang mga returning Filipinos mula sa mga bansang may low-to middle-prevalence ng Covid-19.

Ayon kay Health Undersecretary Maria Rosario Vergeire, hindi na kailangan pang sumailalim sa testing sa points of entry ang mga returning Filipinos mula sa low-risk countries sa kondisyong susunod pa rin ang mga ito sa minimum health standards at papasa sa symptoms screening.
