5 Years of Separation Can Be a Ground For Annulment Under New Bill




It is no secret that the Philippines is one of the very few countries in the world where divorce is not allowed. Aside from that, annulment in the country is considered by many as an expensive and tedious process. And because of that, many couples are tied in the marriage that is no longer working out. To end this kind of sufferings two congressmen filed bills pertaining to annulment and divorce in the country.  Surigao del Norte 2nd District Representative Robert Ace Barbers filed House Bill No. 205 that aims to amend some provisions of the "Family Code of the Philippines". Under his bill, marriage may also be annulled if the parties have been separated in fact for at least five years.  According to Barbers, his bill is base on the factual and existing marital condition of many Filipinos. He added that five years of actual separation would make the couples estrange enough that a possible reconciliation is unlikely to happen. Five years should have also made the parties “adjust and move on with their individual lives without further straining the relationship,” according to him.  On the other hand, Davao Del Norte Representative Pantaleon Alvarez has refiled the absolute divorce. Alvarez pushed the measures during his term as Speaker of the House of Representative in the 18th Congress and was approved on the third and final reading but failed to get approval from Senate.  The bill provides that after the divorce becomes effective, the marriage bonds will be severed and the former spouses will have the right to marry another person either by a civil or religious ceremony.  The measure also ensures that the proceedings for the grant of absolute divorce will be affordable and inexpensive, particularly for indigent litigants and petitioners.  A mandatory six-month cooling-off period will also be provided under the bill. During this period, the court will not start the trial for absolute divorce after the filing of the petition for six months to try to reunite and reconcile the parties.

A new bill that will legalize Church-annuled marriages has been approved by the House committee on population and family relations.  The panel with Laguna Rep. Sol Aragones as a chair  recently approved the bill without a number yet as a substitute for House Bills No. 1629 and No. 3705, both of which sought the recognition of the civil effects of the Church annulment of marriages.       "Church-decreed annulment bill as it is also called, the measure states that whenever a marriage, duly and legally solemnized by a priest, minister, imam, rabbi or presiding elder of any church or religious sect in the Philippines, is subsequently annulled or dissolved in a final judgment or decree, the dissolution “shall have the same effect as a decree of annulment or dissolution issued by a competent court.”     It further provides that the final judgment of annulment issued by the church or religious sect shall be recorded in the appropriate civil registry within 30 days from its issuance. Deputy Speaker Gwendolyn Garcia, one of the authors of the bill, noted that although marriage was an institution that the state had an interest in, it was also considered a “religious act.”    She also said that, logically, if the marriage, insofar as the contracting parties are concerned, is validated by the laws of the Church, then it necessarily follows that by the same laws, such marriage can also be invalidated or annulled. OFWs Are You Infavor of Marriage Dissolution Bill?

After consulting several groups of Overseas Filipino Workers (OFWs) in Hong Kong, members of the House of Representative will also visit OFWs in Japan and the United Arab Emirates next month for consultation on House Bill Number 6027 or the Act Providing For Grounds for Dissolution of Marriage.

Due to physical distance with their spouses, OFWs are often victims of broken relationships.

Last October 1, Representative of Sol Aragones, chairperson of House Committee on Population and Family Relation, ACT-OFW party-list Rep. Aniceto ‘John’ Bertiz Jr., and other congressmen met with some 200 OFWs in Hong Kong.

Several groups of OFWs in Hong Kong expressed their support for the bill authored by House Speaker Pantaleon Alvarez.

Under the proposal, the process for the dissolution of marriage starts with the filing of a joint petition to the court, which includes the agreement of the couple on the custody of the children and their support, as well as the sharing in the division of their properties.

OFWs in Hong Kong said it could simplify the process of ending the failed marriage.

In Rappler's article, Hong Kong-based Filipino journalist and lawyer Daisy Mandap said the Philippines should have a divorce lawyer to limit the burden on OFWs who want to end their marriage.

Mandap added that Atty. Raymond Fortun said that annulment costs P50,000 to P300,000.

She added that the amount is too much for an OFW.

Aside from this OFWs in Hong Kong worry about the future of their investment when their estranged spouses are legally entitled to these under the Family Code.

Husband Stabbed His Cheating Wife To Death In Front Of Their Children


 husband is now facing parricide charges after killing his wife infront of their own kids. The suspect was immediately arrested while trying to escape from the crime scene. the reason behind the killing, his wife came home with smell of liquor and hickeys on her neck giving the husband a suspicion that her wife is cheating with him. With great remorse, the husband, Roque Porton, relates what happened that early dawn when his wife, Jhoanna arrived with smell of alcohol. The suspect ask for forgiveness especially to his children saying that he only did it out of extreme anger. After the stabbing, the suspect immediately left, even asked a neighbor to check if his wife is still alive. The neighbor sought the help of another neighbor who is a police officer and caught the suspect after a short chase. The suspect is now in prison while waiting for the pressing charges against him while their two children will be brought to the custody of the DSWD for psychological debriefing.
