Good News! President Duterte Orders end of Tanim-Bala, No Arrest if Caught in the Airport with Only Bullets!

President Duterte orders the Office of Transportation Security or the OTS to put an end to the bullet-planting modus that victimize the passengers at the Ninoy Aquino International Airport, including tourist and expats or balikbayan as well as OFWs.

Senior Superintendent Mao Aplasca, the new director of the police Aviation Security Group (AVSEgroup), said Thursday that travelers would not be detained or charged in court if an ammunition is confiscated from them, as per  President Duterte's order.


Aplasca mentioned in this video that the Manila International Airport Authority (MIAA), Civil Aviation Authority of the Philippines (CAAP), and the transportation department will form a joint team that will conduct regular security planning for airports. With this order from Duterte, , he said that the tanim-bala is just a thing of the past.

LAGLAG-BALA O TANIM-BALA IS BACK AT NAIA AIRPORT AND THE LATEST VICTIM is 78 and 74 YEARS OLD COUPLE!




No, its not old news, it is as fresh as the lumpia you are eating. Tatay Esteban and Nanay Salvacion Cortabista, age 78 and 74 years old is the newest victim of TANIM-BALA at the NAIA Airport today April 19, 2016!

The two senior citizen couple and Nanay Salvacion was already at the wheel chair was found having the live bullet at the second X-ray at the Ninoy Aquino International Airport terminal 1 as they pass through the scanners on their way to their flight to Los Angeles, California.

NEW MEASURES TO PROTECT OFW IF CAUGHT WITH TANIM BALA AT AIRPORT


IF OFW IS CAUGHT WITH TANIM-BALA AT THE AIRPORT?
AGENCY WILL INFORM EMPLOYER OF THE DELAY OF ARRIVAL
  • POEA WILL PROVIDE ASSISTANCE AND WILL HELP REBOOK FLIGHTS
  • PAO WILL PROVIDE LEGAL COUNSELS/LAWYER
  • OWWA WILL PROVIDE ACCOMMODATION AND ARRANGE TRAVEL/FLIGHT TO PROVINCE

SECTION VI
UNDERTAKINGS OF POEA

6.1. Provide representatives and / or facilitation personnel in NAIA terminals Twenty Four hours a day / Seven days a week to assist 
OFWs intercepted with prohibited items in their person/luggages/cargoes.

6.2. Assist OFW resolve the interception and in some instance, 
earnestly rebook their flights in coordination with airline companies.

6.3. Upon knowledge of a report of an incident, advice the worker emphasizing on his rights as a person who might be, or eventually be, or is already subject of a Custodial Investigation.
6.4. Request the Public Attorney’s Office for immediate designation of a Public Attorney to provide legal representation to the worker during investigation, inquest proceedings, preliminary investigation and trial, as the case may be, if he/she has not yet contacted a lawyer of his/her choice.

6.5. Provide, when needed or as may be requested by law enforcement authorities, documents to establish that the person being held in custody is an OFW.

6.6. Require Recruitment Agencies that deployed the subject OFW to provide assistance to the worker by contacting and making representation with the employer on the potential delay in the worker’s arrival. Information as to the status or circumstances of the case must be treated with utmost confidentiality.
6.7. Undertake public information by incorporating the prohibited acts defined under R.A. No. 10591 in Pre-Employment Orientation Seminar(PEOS) and other workers education programs, including the issuance of advisories.



SECTION VII

UNDERTAKINGS OF OWWA
7.1. Provide immediate assistance to the worker or accompanying family member subject of an investigation especially on his/her welfare needs during the conduct of investigation including safekeeping of their personal belongings;
7.2. Undertake intake interview, where possible, to collect personal information, Overseas Employment Status/Record and further welfare needs of the OFW;
7.3. Provide, when needed, relevant information/documents to show proof that person under investigation is an OFW;
7.4. Contact, upon request of, or with the consent of the OFW, the family,relative or a friend of the worker including counsel of choice if any;
7.5. Provide accommodation when the worker has been released from police custody and while waiting for his/her rebooked flight or arrangements for return to his/her hometown, as the case may be;
7.6. Provide stress debriefing and psycho-social counselling of the subject worker including accompanying family member if any prior to rebooking/redeployment;
7.7. Incorporate prohibited acts defined under R.A. No. 10591 in the Pre-Departure Orientation Seminar (PDOS)

PAO Chief Atty Acosta:We Will Counter File A Case to OTS and Police If They Will Not Stop Planting Bullet!


Inquirer reports that the Public Attorney’s Office (PAO) has threatened to file counter-charges against members of the Office for Transport Security (OTS) and the Philippine National Police Aviation Security Group (PNP-ASG) if “tanim bala” (bullet planting) incidents would continue at the Ninoy Aquino International Airport (Naia).

She said they will file a complaint for planting of evidence.



via Inquirer: "To date, Acosta said 32 cases of tanim-bala have been dismissed by the prosecutors. (Gina) Maliwat, (an OFW based in Macau who was the latest victim of bullet planting at NAIA)in her counter-affidavit which was sworn before the Philippine Consular Office in Macau, said she passed the initial X-ray screening at Naia Terminal II, but it was during the final screening that she was told that a bullet was found in the outer pocket of her shoulder bag.

 “Respondent never dealt with firearms or ammunition. She does not even know how to handle a gun. She never believed in superstitions or amulets. She has absolutely no intention at all to possess the alleged bullet found inside her brown shoulder bag,” Maliwat’s manifestation, submitted to the DOJ through Acosta stated.
Maliwat added that she has no intention to possess or handle bullets.

She said: “I am a mere domestic helper whose dream/intent is to work abroad to help support my family financially.”
The case against Maliwat has been submitted for resolution.

LATEST TANIM-BALA VICTIM: Niece OF Senator Francisco Tatad and 2 Other Passengers





When we assume that the investigation done by NBI would eventually end the tanim-bala scheme, three passengers again fell victim at NAIA this week.



One of the victims, Rosanna Tatad, niece of Sen. Francisco Tatad was stopped while she was about to board her flight on December 13. During the screening process, a bullet was found in her shoulder bag. Her bag was  inspected in the presence of SPO1 Allan Sonio and screening officer Anna Margarita Repario. Upon finding the bullet she was subjected to inquest and charged with violation of Republic Act 10591 but she denied owning it.


On December 15, another passenger named Joseph Ocasiones, 35 years old and American who was travelling with his five-year-old daughter to San Francisco. Screening officer named Rica Verano inspected the bag in the presence of Police Officer 2 Pura Saavedra and security screening officer Arnedo Perez and Airport Police Officer 1 Danilo Santos and found a 9mm calibre bullet in his trolley bag. He was then arrested and detained at the police jail at the airport but denied owning the bullet. “Why would I carry ammunition when I know that it’s prohibited?...I read and saw news from newspapers and on TV that many passengers were caught having bullets in their belongings. I remember when I alighted from the car, I noticed a group of people that included porters blocked my path and the next thing I know, I was arrested for the bullet planted in my baggage.”

The last victim was a 74-year old grandmother bound to Los Angeles, named Araceli Fortuna was also found with two calibre .45 bullets in her luggage.

Through the help of Pasay City Prosecutors, these three (Tatad, Ocasiones and Fortuna) were eventually released and were able to continue their journey according to the news report. But according to another source who claims he is friend with Joseph Ocasiones:

Michael White Case Junked; He Filed Charges to 2 OTS and 4 Police Officer


Pasay court  junked the case filed against Lane Michael White who was arrested last September for  alleged illegal possession of ammunition at the NAIA. The decision was signed by Judge Pedro Gutierrez on Thursday afternoon.

White claims to be a victim tanim-bala and his father believes there is an organized syndicate at the airport.

Meanwhile the National Bureau of Investigation (NBI) will also file robbery-extortion complaint against members of the Philippine National Police-Aviation Security Group (PNP-Avsegroup) for their alleged involvement in the “tanim-bala” or bullet planting racket inside the Ninoy Aquino International Airport (Naia).



On behalf of White, the Department of Justice (DOJ) by the National Bureau of Investigation also filed the following charges to these OTS Personnel and Police Officers :
CASE Filed: Robbery/extortion; violations of Republic Act (RA) No. 7438 (An Act Defining Certain Rights of Person Arrested, Detained or Under Custodial Investigation and Duties of the Arresting, Detaining and Investigating Officers) and RA No. 3019 (Anti-Graft and Corrupt Practices Act); 
Maria Elena Cena -Office for Transportation Security (OTS)
Marvin Garcia - Office for Transportation Security (OTS)

The following Police Officers will also be charged with Violations of Article V, Section 38 (Liability for Planting Evidence) of RA No. 10591 (Comprehensive Firearms and Ammunition Regulation Act); robbery/extortion; and violations of RA No. 7438 and RA No. 3019:
SPO2 Rolando A. Clarin, 
 P/CINSP Adriano Junio, 
SPO4 Ramon Bernardo, and 
SPO2 Romy Navarro of the Philippine National Police-Aviation Security Group (PNP-AVSEGROUP).

NBI Report Confirmed Modus of Tanim-Bala/Laglag-Bala at NAIA But it is Not a Syndicate

NBI confirmed in their report that there is a modus of tanim-bala inside the NAIA airport but it is not syndicate. They also believe there are police and some officers involve in the modus. They will submit their report to the DOJ. Watch the video below.

AMERICAN VICTIM OF LAGLAG-BALA, CRIES JUSTICE.


American missionary Lane Michael White cries for justice.
He narrated the trauma they experienced because of the incident. "I felt betrayed. We came here to help the people...And then they did this to us," said Lane.
 He said he will never forget how he was treated by the security screener Maria Elma Ceña and Marvin Garcia. "... She screamed at me...They wouldn't let me touch the bag and told me to stand back. So I don't think that's their procedure. I think they should ask me if they can get into the bag... they didn't do that." He said SPO2 Rolando Clarin acted mad and kept insisting that he just pay Php 30,000 so he doesn't have to go through court and that he could possibly be thrown in jail. 
Their family is hoping that they will be the key to the investigation to stop the tanim bala scam and that they would be given justice.






Lane Michael White still has hold departure order and cannot come back to his home country until his case gets cleared. "I pray for the case to be dismissed, so I can go home," he added.

DAVAO City Mayor Rodrigo R. Duterte calls on President Benigno C. Aquino III to stop the ‘tanim-bala’ modus at the Ninoy Aquino International Airport, saying that he never asked the president any favor in exchange for his support in the 2010 elections until now

Duterte made an appeal to President Benigno C. Aquino III last Monday to make drastic moves to solve the problem, saying that he never asked for any favor in exchange for his support, except this one.
He also said that the President must relieve all officials and employees connected to the Civil Aviation Authority of the Philippines (CAAP) and the aviation command including also the porter services and drivers.
Duterte said only a conspiracy with porters, drivers, and airport authorities can create such a situation.

SEAMAN WHO POSTED IN FACEBOOK OVER TAXI PLANTING BULLET ORDERED ARREST?

"THE LAND Transportation Franchising and Regulatory Board (LTFRB) has cited for contempt Julius Neil Habana, a seaman who posted on social media that a taxi driver had planted a bullet in his friend’s bag, for failing to appear before the agency to substantiate his allegations.
“It appearing that Habana refused to appear before this court despite efforts by the board, let contempt order be issued until he appears and makes himself available for investigation,” LTFRB Chair Winston Ginez said during Tuesday’s hearing.
“In the meantime, this case shall be archived until the arrest of Habana is made possible by law enforcement officers,” Ginez added."

Habana apparently told the process server that he was already in Iloilo province and would like the hearing to be held there, LTFRB board member Ariel Inton mentioned during the hearing.
“Because of his conduct, I would recommend the board to cite him [for] contempt,” Inton said.
Ricky Milagrosa, the taxi driver implicated in the alleged “tanim-bala” extortion scheme, said he would file a case against Habana since the accusation had affected his work and led to his child being bullied at school.
A nationwide taxi organization has come forward to assist in the filing of the case.
“Taxi drivers already have a bad image and we want to change that. We came here to observe the hearing. If the driver committed wrongdoing, we would [seek] the revocation of his license. But it seemed the allegation was fabricated and only created panic among passengers,” said Fermin October, national president of Dumper (Drivers Unite for Mass Progress and Equal Rights).
In a post on Facebook, Habana said that his fellow seaman boarded Milagrosa’s taxi from Sampaloc, Manila to the Ninoy Aquino International Airport on Oct. 29.
Habana said his friend informed him through text that he saw the driver put something in his bag. He added that he advised his friend to go instead to his boarding house in Malate, Manila where he claimed they found a bullet in the bag.
