Tagalog: Mga Tanong at Sagot sa RA11235 o Doble Plaka Law (Motorcycle Crime Prevention Law)

Ayun sa balita, ang mga gumagamit ng motorsiklo na hindi nakarehistro o nakapangalan sa kanila ay kailangang may dalang proof o katibayan na kayo ay authorized na gamitin ito dahil pinapatupad na ng Land Transportation Office ang Republic Act 11235 — also called the Motorcycle Crime Prevention Act — o Doble Plaka Law

Ang RA 11235 o tinatawag na Motorcycle Crime Prevention Law o mas kilala sa tawag na Doble Plaka Law ay nilagdaan ni Pangulong Rodrigo Duterte noong March 2019
Sa ilalim ng “Doble Plaka Law”, lahat ng mga motorsiklo, maliit man o malaki ay kinakailangang magkaroon ng plaka sa harap at likod ng kanilang motor, at maaring magmulta ng P50K hanggang P100K at pagkakulong ang sinumang lumabag sa batas na ito.

Samantala, ayun kay Land Transportation Office (LTO) Executive Director Romeo Vera Cruz ang “Doble Plaka” law na makakaapekto sa milyong motorista ay hindi kaagad maipapatupad “Hindi pa po natin ito ma-implement kasi hindi pa po available ang mga plaka,” ayun pa kay Cruz, na idinagdag na wala pang rider na mahuhuli sa ngayon dahil sa kakulangan ng plaka.

SAGOT: Oo. Lahat ng motor ay sakop nitong batas.

TANONG: Kailan kami mag-aapply ng bagong plaka?
SAGOT: Sundin ang inyong registration schedule. Dun kayo ma-iisyuhan ng panibagong plaka. Sa ngayon, status-quo muna tayo sa temporary plate.

TANONG: Kailangan ko ba mag lagay ng temporary plate sa harap habang hinihintay ko ang aking bagong plaka?
SAGOT: Hindi.

MGA KATANUNGAN HINGGIL SA PAGMAMAY-ARI
TANONG: Kailangan ba naming magpapalit ng ownership sa rehistro?
SAGOT: Oo. Ayun sa batas na RA11235. Ang sinumang may-ari na hindi makakapagrehistro ng kanilang motorsiklo sa loob ng limang araw na nabili ito ay magbabayad ng P20K hanggang P50K. Posible din silang makukulong.  

TANONG: Kailan ito magiging epektibo?
SAGOT: Dahil sa ECQ at MECQ, hangga't hindi pa nagbubukas ang LTO sa lugar ninyo, hindi pa ito nag-aapply sa inyo. Pero sa GCQ, maaring asikasuhin na ito upang 'di na kayo magka-aberya sa kalsada. Tandaan, 5 days pagkatapos ma issue ang sales invoice at 3 days after ma-notaryo ang Deed of Sale (DOS) ang palugit para mailipat ito sa pangalan ninyo.

SAGOT: Hindi. Ang DOS ay hindi attachment sa rehistro upang magamit ang sasakyan nyo. Kasangkapan lang ito para sa paglipat ng ownership ng isang bagay sa iyo.

TANONG: Nakapanagalan sa aking kamag-anak (magulang, kapatid, anak, kamaganak, kaibigan) ang motorsiklo. Kailangan ko ba itong ilipat sa pangalan ko?
SAGOT: Walang sinabi sa batas na hindi ka pwede gumamit ng motor na hindi iyo, subalit kailangang mapatunayan mong kamag-anak mo sila. Walang problema ito kung may relasyon ka sa may ari, pero kung previous owner ito, may pananagutan ka na.

TANONG: Nakapangalan sa opisina ang motorsiklo, kailangan ko ba ilipat ito sa pangalan ko?
SAGOT: Hindi. Humingi ka ng Authorization Letter o Motorpool Pass na sayo naka-intrega ang motorsiklo mo at dalin mo ito palagi.

TANONG: Repo o Repossessed ang motor ko na nakapangalan pa sa original owner. Paano po ito?
SAGOT: Kausapin nyo ang kasa. Ayon sa batas, hindi pwede manatili sa pangalan ng previous owner ang inyong motorsiklo. Hindi nila pwede i-hostage ang pangalan sa rehistro para magbayad kayo dahil may kontrata naman yan. Pag ayaw nila pumayag, isumbong nyo sa LTO.

TANONG: Sarado pa ang LTO sa mga ECQ at MECQ na lugar, pano po ako mag papa change ownership?
SAGOT: Wala kang pananagutan habang sarado ang LTO sa inyong lugar. Oras na mag bukas ito, saka ka lang pumunta para gawin ito.
TANONG: Hindi na mahanap, nasa ibang bansa o patay na ang original owner. Pano ako makakapag pa transfer?
SAGOT: Kausapin nyo ang Notaryo (NOTARY PUBLIC) para sa ganitong sitwasyon. Sila ang nakaka-alam ng mga kailangang papeles para dito. Pwera sa nasa ibang bansa pero nakakausap ninyo, pwede kayo humingi ng DEED OF SALE (DOS) na ipapadala via SNAIL MAIL at kayo na mag papa notary dito sa bansa.
TANONG: Ano ang kailangan para sa change ownership?
SAGOT: PNP-HPG clearance ng sasakyan, Deed of sale, Photocopy ng ID ng previous owner na hindi pa paso at application sa LTO.
TANONG: Magkano aabutin sa gastos ng pagpapalipat?
SAGOT: Sa huling ulat, nasa PhP200+ sa change ownership, PhP300+ sa PNP clearance ng sasakyan ang magagastos.

TANONG: Pano kung wala kaming pambayad pa dahil nawalan kami ng trabaho at wala pang pangastos?
SAGOT: Pumunta pa din kayo sa LTO upang mag palista at sabihin na babalik agad kayo pag kaya niyo na itonog bayaran. Patunay ito na hindi kayo nagpapabaya at may intensyon kayong sumunod sa sinasabi ng batas.
TANONG: Pati ba sa kotse o apat na gulong itong RA11235?
SAGOT: Ayon sa original na batas, sa pag bili mo ng sasakyan, dapat mo ito ilipat sa pangalan mo. Pero sa batas na ito, motorsiklo lang ang may penalty na 20k-50k, may posibilidad pang abut sa P100K o kulong o pareho.

Sa bagong labas na IRR; ang isang motorsiklo na may hindi mabasang plaka o walang plaka sa harap o sa likod, ay magbabayad ng P50K sa unang violation, at P100K sa pangalawang violation. Ang motorsiklo ay maiimpound rin. 

Tanong: Paano kung ninakaw ang aking plaka?

Sagot: Kailangan itong maireport  sa loob ng 24 oras. Ang sinumang lumabag nito ay posibleng magmumulta ng P20K to P50K.

What are the loan purposes? How much can a member borrow?   • A qualified Pag-IBIG member may borrow up to a maximum amount of ₱750,000.00, depending on the member’s actual need, his loan entitlement based on gross monthly income, his loan entitlement based on capacity to pay, and the loan-to-appraisal value ratio, whichever is the lowest.   What is the loan to appraisal value ratio?  The loan to appraisal value ratio is: Loan Amount Loan-to-Appraisal Value Ratio Up to ₱450,000 100% Over ₱450,000 to ₱750,000 90%   What are the interest rates ?  For the first ten years of the loan, interest rate for loans of up to ₱450,000 is 3% provided the gross monthly income is ₱15,000 for those working in the NCR and ₱12,000 for workers in other regions.  For loans of up to ₱750,000, the interest rate is 6.5%, provided the gross monthly income for those working in the NCR is not more than ₱17,500, and not more than ₱14,000 for workers in other regions.  At the end of the ten-year period, the interest rate shall be re-priced based on the prevailing interest rate in the Fund’s pricing framework or it shall be increased by 2%, whichever is lower. Said interest rates shall be re-priced periodically depending on the chosen fixed pricing period of the borrower.  The base rate for succeeding re-pricing shall be the interest rate for the immediately preceding re-pricing period. The Pag-IBIG housing loan may be used to finance any one of the following:  • Purchase of a fully developed residential lot or adjoining lots not exceeding 1,000 square meters;  • Purchase of a residential house and lot, townhouse, or condominium unit;  • Construction or completion of a residential unit on a lot owned by the member. How much can a member borrow?   • A qualified Pag-IBIG member may borrow up to a maximum amount of ₱750,000.00, depending on the member’s actual need, his loan entitlement based on gross monthly income, his loan entitlement based on capacity to pay, and the loan-to-appraisal value ratio, whichever is the lowest.   What is the loan to appraisal value ratio?  The loan to appraisal value ratio is: Loan Amount Loan-to-Appraisal Value Ratio Up to ₱450,000 100% Over ₱450,000 to ₱750,000 90%   What are the interest rates ?  For the first ten years of the loan, interest rate for loans of up to ₱450,000 is 3% provided the gross monthly income is ₱15,000 for those working in the NCR and ₱12,000 for workers in other regions.  For loans of up to ₱750,000, the interest rate is 6.5%, provided the gross monthly income for those working in the NCR is not more than ₱17,500, and not more than ₱14,000 for workers in other regions.  At the end of the ten-year period, the interest rate shall be re-priced based on the prevailing interest rate in the Fund’s pricing framework or it shall be increased by 2%, whichever is lower.
