SIM Card Registration Bill, aprobado na sa Kongreso

MANILA, Philippines — INAPROBAHAN na sa 3rd at final reading ng House of Representatives ang panukalang batas na magpapatupad ng SIM card registration.

Mahigit sa 180 na mga mambabatas ang pumabor sa House Bill 5793 habang anim ang umayaw at walang nag-abstain.

Sa ilalim ng panukalang batas, kailangang mag-presenta ng valid o government-issued ID na may pictures ang SIM card user bilang patunay sa identity nito sa teleccomunication company o sa direct seller.

Kailangan ding lumagda sa control-numbered registration form ang gagamit ng SIM card bilang patunay na iisang tao lamang ang bumili ng SIM card at ang pupirma sa registration form.

Maaari namang tumanggi ang seller o telco sakaling hindi masunod ang nabanggit na mga requirements.

Sakali namang walang anumang government-issued ID ang bibili, maaaring mag-presenta ito ng NBI clearance, police clearance o Philippine Statistics Authority o PSA certified birth certificate na may ID picture na kinunan sa nakaraang anim na buwan.

Magiging subject naman ng confidentiality clause ng panukalang batas ang mga impormasyong isusumite ng mga SIM card user, maliban na lamang kung may written consent mula sa user.

Required naman ang mga telcos na ilabas ang mga detalye sakaling may court order o subpoena o kung may written request mula sa law enforcement agencies para sa nagpapatuloy na imbestigasyon partikular na kung nagamit ang SIM card sa krimen o illegal na aktibidad.

Sa ngayon, pending sa Senado ang kahalintulad na panukalang batas at nasa second reading na ito.

Samantala, inihayag naman ni Senator Sherwin Gatchalian, ang principal author ng Senate version ng panukalang batas, na umaasa itong matatapos na ang kanilang diskusyon dito sa Enero.

"Hindi 'yan aabot this year, but sigurado ko, aabot 'yan January," pahayag ni Gatchalian.

"Kasi advanced stage na rin dito, nasa floor na. Sa aking pakikipag-usap sa ibang mga senador, wala namang tumututol dito, at lahat, mukhang almost everyone agrees na dapat mayroon na tayong ganito," dagdag pa nito.

Agad naman na nagpahayag ng suporta ang PLDT at ang wireless arm nito na Smart Communications sa panukalang batas dahil malaking tulong umano ito upang masawata ang mga SMS-related cybercrimes.

"The SIM card registration bill will definitely lessen the proliferation of fraudulent spam messages similar to the Smishing cases being encountered now and boost telecom security efforts as well. It will also boost e-commerce adoption and growth," ang naging pahayag ni Smart Communications vice president Roy Ibay.

National Identification (ID) System and Sim card Registration. Will it really help prevent crimes in the community?

This is the claims of the proponent of the two out-dated bills in the Congress but until now, fails to pass into law.

The proposal to have a nationwide mandatory registration of prepaid subscriber identification module (SIM) cards is being pushed in the Senate to address mobile-related crimes.

Senate bill number 7 or the Sim Card Registration Act of 2016 seeks to "eradicate mobile phone-aided terrorism and criminal activities" by registering all prepaid SIMs and limiting each person to own only up to three SIM cards "across all service providers."

According to Senate President Koko Pimentel, that there are people who have criminal minds and abuse the non-registration and loose SIM card registration.

One of the examples was the Davao City bombing where the bomb was allegedly detonated using a cellular phone.

Should the bill be passed into law, a registered SIM card owner should be at least 15-years old.

PNP-NCRPO director Chief Supt. Oscar Albayalde said, criminals often use sim card in making threats and if registered, this kind of activity will be traced.

He is also in support of the National ID system as one strategy of preventing and solving criminality in the country.

On the other hand, House Speaker and Davao del Norte Representative Pantaleon Alvarez believes that the proposed National Identification system can be of great help in curbing criminality under the Duterte administration.

Alvares said national ID system can fast-track the solution of crimes.

Although security and privacy concerns are valid, he said: “we should not lose sight of the benefits or advantages of having a uniform computerized system of identification of Filipino citizens wherever they may be.”

In light of recent bomb threats thru text, extortion thru text, text spam/scam, and using a cellphone as triggering device in the bombing,  Senator Win Gatchalian urged President Rodrigo Duterte to certify as urgent a bill which mandates the registration of prepaid subscriber identity module (SIM) cards.

According to Gatchalian, this would help curb increasing number of text message bomb threats in recent weeks.

Gatchalian is the author of Senate Bill No. 203, otherwise known as the "SIM Card Registration Act."

Since the bombing in Davao City, many bomb scares thru text have caused alarm and panic in different areas in the country.

"Mandatory registration of prepaid mobile numbers will discourage ill-willed pranksters and allow us to punish those who currently perpetrate security scares through text message with impunity. More importantly, this measure will empower law enforcement authorities to trace and suppress legitimate terror threats during these uncertain times," said Gatchalian, a member of the Senate Committee on National Defense and Security.

Under Senate Bill No. 203

• All direct sellers of prepaid SIM card must compel buyers to present a valid photo ID before completing the sale

• The direct seller shall require the buyer to accomplish and sign controlled number registration form issued by the respective Public Telecommunication Entity (PTE) of the sim card being purchased

• Current owners of prepaid SIM cards would be mandated to register themselves and their mobile numbers within 180 days from the effectivity of the law

• Existing SIM cards which are not registered within the 180-day period would be automatically scheduled for deactivation.

However, Gatchalian assured the public that their cellular data information would still be kept confidential in accordance with the constitutional right to privacy and applicable laws.
