SC, Simplifies Debt Collection Under Revised Small Claim Procedure

The Supreme Court is pushing a fast and simple process in claiming money or debts under revised small claim procedure.  In ABS-CBN report, instead of years, you can get a decision of a case within 30 days from the day of filing.  Filing of civil cases in metropolitan and municipal trial courts are made easy if it is about money claims.  This includes payment for the loan or debts, rent, services, sales, and mortgages.




The Supreme Court is pushing a fast and simple process in claiming money or debts under revised small claim procedure.

In ABS-CBN report, instead of years, you can get a decision of a case within 30 days from the day of filing.

Filing of civil cases in metropolitan and municipal trial courts are made easy if it is about money claims.

This includes payment for the loan or debts, rent, services, sales, and mortgages.

The lawyer is not needed if money claims are not more than P200,000 under revised small claims procedure. All you need to have is small claim forms and supporting documents or evidence.

After the filing of a case, the respondent will be notified and will be asked to answer the charged against her or him. The court will set the date of hearing not more than 30 days from the date the case has been filed.

If the case is not settled in a hearing, the judge will give a decision within 24 hours.




The Supreme Court sees that revised small claim procedure as a solution to reduced thousands of cases filed in court and to provide remedies for the poor who cannot afford to get a and pay a lawyer.

The filing fee is also cheaper and there's a possible exemption for the indigent.


But, for the system not to be abused, additional charges will be imposed for each additional defendant. There's an extra charge when a person files a case for more than five times in a year.

According to Supreme Court, in 2016, about 13,000 small claim cases were solved, much higher from 10,000 cases solved in 2015.
