UAE LABOR LAW: DEATH COMPENSATION FOR EXPATS

 Article 149 Federal Labour Law No. 8 of 1980,  states the following:  "If the employee dies as a result of a labour accident or occupational disease, the employee's family members shall be entitled to an indemnity equal to the basic pay of the employee for a period of 24 months, provided that the amount of indemnity shall not be less than eighteen thousand Dirhams and not more than thirty five thousand Dirhams. The amount of indemnity shall be calculated on the basis of the last pay earned by the employee prior to his death."   In case that an OFW or expatriate working in UAE met an untoward incident that causes them to lose their life while performing their duties, the UAE labor law stated that the bereaved family of the deceased  will receive compensation from employer.    For natural death occurred outside work duty,  the employer has the responsibility to pay the family members of the deceased or the dependents, the amount equivalent to the worker's 24 months basic wage.   On the other hand, if death occurred while the expat is performing his duty or if the expat contracted a disease while working [i.e. a lung cancer from inhaling harmful toxins while working in a chemical factory], their dependents or the immediate family members are entitled for the amount equivalent to the workers 24 months basic wages not lower than AED 18,000 but must not exceed AED 35,000. it must be based on the salary of the worker prior to their death.   The expression “Deceased worker's Family”  stated on the article's provision is defined as:  -Children.   -Widow/widower.  -Dependents who were subsistent on the deceased worker's income.  -Sons who were under the age of 18 and who were enrolled in educational institutions regularly and are under the age of 24 years and who were mentally or Physically disabled to earn for a living and who were in the deceased workers care at the time of his death.  -Unmarried daughters who were in the deceased workers care at the time of his death.  -The parents.  -Brothers and sisters who were in the deceased workers care at the time of his death. A person's death can be considered as unfortunate especially if the person died is the sole breadwinner of the family. The compensation may not be a big chunk of cash but it would help the family of the deceased somehow.
