TEXTING, SURFING THE NET WHILE DRIVING? READ THIS "BETTER SAFE THAN SORRY"


Many of us have already encountered drivers who are texting while on the road, talking on their cell phones, watching basketball, news or checking social media accounts while on their wheels.  Unmindful of the possible accidents we can see this kind of drivers, both young and old in our roads.   But not this time, it is after Congress passed an Anti-Distracted Driving  Act in the Philippines  It passed through Senate last May 2016 and lapsed into law last July 21 after it was not signed by President Benigno Aquino III during the 30-day period.  The Anti Distracted Driving Act (ADDA) aims to avoid an accident caused by driver distraction.

The Anti Distracted Driving Act (ADDA) aims to avoid an accident caused by driver distraction.


Under the law, ‘distracted driving’ is the of act of writing, reading, sending a text-based message, making phone calls, or watching movies, surfing the internet, reading an e-book or performing any sort of computation on a mobile device by a motorist.

Under the law, it is illegal to use mobile devices like phones, tablets, laptops, and other gadgets while the vehicle is in motion or while temporarily stopped at a red light.

Here are few exemptions;

  • Using a mobile phone for emergency purposes.
  • Using a hands-free device such as Bluetooth connection but for as long as the device is mounted away from the driver’s line of sight.
  • When the driver has pulled the vehicle to a curb and is fully stopped.

ADDA allows instances when certain devices may be used. Using a mobile communications device is not distracted driving if done through a hands-free function, such as with a speaker phone, earphones, or similar devices, which allow a person to have calls without holding the device.

ADDA does not distinguish diplomatic, public or private vehicles.

VIOLATIONS AND FINES:

  • First Offence - P5,000
  • Second Offense - P10,000
  • Third Offense - P15,000, including suspension of driver's license for three months
  • Fourth Offense - P20,000, including revocation of driver's license.
Public Utility Vehicle (PUV) drivers, drivers of school service vehicles or drivers of a common carrier of flammable or toxic materials caught in violation of the bill within a 50-meter radius of a school will be fined Php 30,000 and driver’s license suspension for three months.

The Department of Transportation and the Land Transportation Office will implement the new law, together with the Metro Manila Development Authority and the Philippine National Police and other concerned agencies as enforcers.
