Good News or Bad News? UAE Will Hire New Domestic Helpers From the Philippines!

A big piece of news has come directly from the POEA. Labor Secretary Sylvestre Bello III himself has confirmed that the UAE is again set to hire Filipino household service workers soon. This comes as an agreement has been signed by the Philippine and UAE government representatives, effectively lifting the ban of hiring new Filipino domestic workers since June 2014.  The ban came to effect due to conflicting recruitment policies between the two governments. Agencies have been abusing the UAE tourist visa system to bring maids to the UAE, changing their status once they arrive. The ban has not stopped the hiring, but it has increased the cost of hiring maids from the Philippines, usually via different visas or via a third country. This combination opens the door for abuse.  A previous effort to lift the ban did not flourish due to what was seen as too-strict requirements from both sides.  The newly-forged agreement is set to end the previous practice of hiring maids and facilitate the process for approving and recruiting domestic workers in a way that ensures transparency between the contractual parties and that the process is in accordance with the laws of both countries.  The memorandum was signed in Abu Dhabi on Tuesday by Saqr Ghobash, the Minister of Human Resources and Emiratisation for the UAE, and Silvestre Bello III, the Secretary of Labor and Employment for the Philippines.  The MoU is a result of many consultations held between the two countries. The UAE Ministry of Human Resource initiated the move by contacting its counterparts in countries from which the UAE has a huge demand for domestic workers, including the Philippines.  Sec. Bello said that the MoU enhances the partnership between the UAE and Philippines regarding Overseas Filipino Workers in the UAE, as well as improving the management of the contractual period between employers and expat workers.  The MoU stipulates a list of procedures concerning the different stages of the contractual process. The employment of domestic workers will follow the UAE Model Contract, including the following points: The recruitment office is tasked with sending the job offer to the employee in their home country The job offer has to include the list of the obligations of the employer and employee  The contract will be signed by the employer and employee upon the arrival of the worker in the country Awareness and guidance programs will be given to the employer. The employee will also receive awareness and guidance programs prior to leaving the Philippines (PDOS). The programs will inform employer and employee about their rights and obligations towards each other.  Recruitment of Filipino household service workers will begin once all the necessary procedures are established for facilitating the recruitment process. Only recruitment agencies registered with the ministry are able to offer recruitment and employment applications for domestic workers.

MOL: HSW or Kasambahay in Saudi With Delayed Salary Can Now Transfer to Other Employers

Household Service Workers or Domestic Workers in Saudi Arabia are no longer need to suffer non-payment of wages.  This is after the Ministry of Labor and Social Development (MoL) confirmed that domestic workers can transfer to other employers if the current employer is late in paying wages or salaries for three consecutive months.  This is based on 13 ministerial decision of Labor Minister Ali bin Nasser Al-Ghafis that endorsing the transfer of services of domestic workers from their current employer to a new one.






Household Service Workers or Domestic Workers in Saudi Arabia are no longer need to suffer non-payment of wages.

This is after the Ministry of Labor and Social Development (MoL) confirmed that domestic workers can transfer to other employers if the current employer is late in paying wages or salaries for three consecutive months.

This is based on 13 ministerial decision of Labor Minister Ali bin Nasser Al-Ghafis that endorsing the transfer of services of domestic workers from their current employer to a new one.




MoL spokesman Khalid Abalkhail gives three instances where domestic workers have the right to transfer his/her service;

1. Failure of employer to pay DH salary for three consecutive months without giving reason to his/her employee

2. When the employer is not present to receive the worker at the port of entry into the country

3. Failure of employer to take a worker from the shelter house within 15 days from the date of arrival

4. Failure of employer to obtain residency permit for his/her employee

5. Failure of employer to renew the expired residency permit within 30 days of the expiry date





6. Workers can transfer from one employer to another in cases where the employer leased the services of the worker to others without the knowledge of the worker or assigning him/her to work for non-relatives of the second degree

7. If a worker was commissioned to perform hazardous tasks that threaten his/her health and safety.

8. If the worker is abused

9. If the worker has a formal complaint against her/her employer

10. Other cases for services transfer include situations where employers file invalid complaints against absent workers; when the employer fails to attend two sessions addressing a complaint filed by the worker; and in cases where the employer is absent either for travel or imprisonment, death or any other reason that resulted in failure to pay wages for three consecutive months.






With this, under the directives, the new employer will pay the transfer fees and costs of sheltering the worker during his/her stay in the shelter house, which amounts to SR150 ($40) per day.

Because of touching and hugging his Pinay maid, Malaysian gets jail, caning


A Malaysian employer has been sentenced to 11 months in prison and three strokes of a cane for molesting his Filipina domestic helper in Singapore.  According to the report, Jacob Kumar Ross B. Isaac Ross, 40, a Singapore permanent resident, had begun touching and hugging the 30-year-old Filipina inappropriately from January 1 to 10, 2016.  This happened when the Pinay maid started to work for his family.



A Malaysian employer has been sentenced to 11 months in prison and three strokes of a cane for molesting his Filipina domestic helper in Singapore.

According to the report, Jacob Kumar Ross B. Isaac Ross, 40, a Singapore permanent resident, had begun touching and hugging the 30-year-old Filipina inappropriately from January 1 to 10, 2016.

This happened when the Pinay maid started to work for his family.



In court, it said that the Filipina did not like what his employer doing and rejected the Malaysian every time.

Sometime after January 10, 2016, he told her that he “wants her by the end of the month.”

Afraid and terrified, the Pinay domestic helper decided to inform her agent and the wife of his employer.

Ross got a warning and been asked to stop molesting his domestic worker.

He apologized to the victim. But not long after, he told her to apply medicated oil on his lower back, using a roller.

The Pinay got worried again and inform his wife who took her on March 9 to a police station to make a report.




Last February 28, Ross was sentenced to 11 months in prison and three strokes of the cane after he admitted to two of four counts of molesting the victim.

According to Deputy Public Prosecutor (DPP) Chee Ee Ling, Ross had abused his position of authority, and it was not something that occurred on impulse but a sexual harassment that happened continually over a span of four days.



It narrates that on January 7, in the children's room, Ross entered and kissed the victim. She pushed him away and told him he could not kiss her because she was his maid.

Two days later, he again molested her and hugged her while she was working in the children’s room.

When she pushed him away, he asked whether she wanted to see his private parts. 

She said no and immediately turned away and left.

Pinay DH testifies in court against employer


Many household workers experience sexual harassment or abuse by their employer but only a few have the courage to report it and fight for their right.  Just like the case of a 24-year old Pinay domestic helper in Hong Kong who testifies in court against her former employer.  This is in line with the trial for the two counts of indecent assault where she is a victim.  Last February 8, the said Pinay was called to be the first witness by the prosecution at Shatin Magistrates’ Courts. This was the first trial day of charges filed against an employer named Ong C.K.
Many household workers experience sexual harassment or abuse by their employer but only a few have the courage to report it and fight for their right.

Just like the case of a 24-year old Pinay domestic helper in Hong Kong who testifies in court against her former employer.

This is in line with the trial for the two counts of indecent assault where she is a victim.



Last February 8, the said Pinay was called to be the first witness by the prosecution at Shatin Magistrates’ Courts. This was the first trial day of charges filed against an employer named Ong C.K.

Identified only as Miss X, the witness recounted two incident in 2016 when she felt "violate" by her 60-year-old employer.

Miss X said the first incident happened on April 30, 2016, her third day of work in Ong's Family.

She said that was around 3:00 pm while she was doing dishes, her male employer asked her if there was anyone else in the house, and she said that there were just the two of them.

The defendant allegedly went to his study room in the house’s fourth floor and buzzed the intercom to ask the witness to bring lemon tea to him.

After bringing the tea to her boss, he then asked her if she could give him a massage. She agreed and then he sat on the massage chair. But after agreeing to massage his shoulder and his feet, the defendant allegedly stood up, took off his shorts, grabbed her wrists and placed them on his private part.

“I was shocked and wondered why he took off his shorts,” the witness said through an interpreter.

“Massage it,” Ong allegedly then told the helper.

She added that she could feel his private part as the fabric of his underwear was “flimsy”.

The helper then said she would not do it because what he was asking her to do was “sexual harassment” in the Philippines.

The employer allegedly said that he would be willing to pay her $80 for the service as it was the same amount he usually paid when he had massages outside.

The witness said she took away her hands and then left the study room, telling the employer that she still had some things to do in the kitchen.

THE SECOND INCIDENT

Miss X said it happened on May 9, 2016, when she and the other Filipino helper were summoned by the employer to the study room and told them about how the monkeys came to the garden and destroy the plants.

She said, the employer then took his rifle and told them that he would teach them to shoot the monkeys.

The other Filipino helper told the employer that she knew how to use the rifle because her husband is a policeman in the Philippines.


The defendant then instructed Miss X how to hold the rifle, and told her to point the gun to the tree in the garden and pretend that it was a monkey. The witness said because she found the gun heavy, her arms would fall, so the employer stood behind her and helped her hold the gun.

While telling her how to pull the trigger she felt his hand fondle her breast.

“It took me by surprise. I felt harassed, violated so I put the rifle down,” she said after demonstrating to the court how she had held the rifle and how she was told to point the gun outside the window.

She and the other Filipino helper then told their employer that they still had some chores to finish downstairs.

Miss X said, she reports both incidents to her employment agency.

She said she was able to report the incidents to the Philippine Consulate after she got in touch with a leader of an OFW group who helped her.

On June 8, 3016, the defendant was arrested by the police.

Magistrate Colin Wong Sze-Cheung adjourned the case for a verdict on February 23.

      DUE to debt, a Filipina domestic worker in Hong Kong was strangled after physically assaulted by a 56-year old South Asian man.  The incident happened in footbridge in Central last December 4 and several Filipino household workers were able to take the video of the said incident.  In a video posted on Facebook by a netizen, the man is seen shouting at the Filipina, pulling her back, grabbed her by the neck and strangled her. The Filipina, who named was not released was taken to Queen Mary Hospital by police officers who responded to a 999 call. She was reportedly discharged after being declared in good condition. The helper, Johana Periera had been working for her employer for five months in Hong Kong.  Police said she was “found collapsed” and certified dead, with no suspicious circumstances. Her body was taken to a hospital for postmortem examination.    (Periera was found dead in one of the tower blocks  in Royal Ascot in Shatin)  According to the report, Periera complained to her employer that she's having a migraine last December 3.  She was told to rest until the next day which happens to be Sunday and her day off.  The employer found her unconscious, Sunday night but the emergency response from police and ambulance staff said, she was dead.  According to her friends in the area, they did not know that Periera is suffering from a migraine but prior to the incident, she reportedly had an argument with her employer.
