Proseso ng annulment sa Pilipinas, isinusulong na mapabilis



MANILA, Philippines — PILIPINAS na lamang ang nag-iisang bansa sa buong mundo na walang divorce. Maliban dito, nananatili namang mahirap, magastos at matagal ang proseso ng kasalukuyang annulment proceedings sa bansa.

Dahil dito, isang panukalang batas ngayon ang inihain sa House of Representative na may layuning mapabilis ang dissolution at annulment of marriage sa pamamagitan ng paglabas ng proseso sa Office of the Solicitor General o OSG.

Sa ilalim ng House Bill 9774 o the Family Law Reform Act of 2021 na inihain noong Hulyo 5 sa Kongreso, nakasaad na ililipat sa Public Attorney's Office o PAO, Department of Social Welfare and Development o DSWD at sa Integrated Bar of the Philippines o IBP ang papel o role ng OSG sa mga family law cases.

Ayon sa may akda ng panukalang batas na si Bohol Representative Kristine Alexie B. Tutor, na sakaling maging batas, ang lahat na kaso na may kaugnayan sa marriage annulment ay malilipat sa PAO at DSWD mula sa OSG.

Sa ilalim ng nabanggit na house bill, inaatasan ang DSWD na bumuo ng Family Relations Welfare Office na magsisilbing staff support sa PAO na siyang sasakop sa lahat na aspetong may kinalaman sa social services ng kaso.

Bubuo naman ang PAO ng Special Branch ng Family Law na hahawak, tututok at tatalakay sa mga kasong may kaugnayan sa annulment.

Paliwanag ni Tutor sa ilalim ng panukalang batas, maaaring ma-desisyunan sa loob ng isang taon ang pagpapawalang-bisa sa kasal sa pamamagitan ng annulment.

“The bill sets a timeline of up to 360 working days for the hearing and resolution of annulment and other Family Law cases: 180 days at the Family Court and 180 days on appeal,”paliwanag ni Tutor sa isang news release.

“It also sets fifteen days for the religious authorities, the office of the civil registrar, and the Philippine Statistics Authority to record the annulment or dissolution of marriage in the official government records.” dagdag pa ng mambabatas.

Pinapahintulutan din ng panukalang batas ang kasunduan ng PAO at IBP na payagan ang grupo ng mga abogado na magtalaga ng miyembro na libreng hahawak sa mga kaso upang matugunan ang kakulangan ng mga abogado sa PAO.

Kinumperma din ni Tutor na suportado ng dalawang obispong Katoliko sa Talibon at Tagbilaran, kapwa sa Bohol ang panukalang batas nito na Family Law Reform Act of 2021, dahil sa hindi maitatangging “painful reality of invalid marriages”.

Kinikilala umano ng nabanggit na mga religious leaders ang tatlong main advantages ng panukalang batas na kinabibilangan ng mga sumusunod:
  • Pagbibigay-awa sa mga biktima ng kasal na hindi wasto mula sa simula.
  • Access sa annulment at marriage dissolution sa mga mahihirap na mag-asawa.
  • Pag-iwas sa mga hindi na kailangang procedure at posibleng duplication.

Speaker Alvarez, To File "Flash Separation" Bill to dissolve Loveless, Unhappy Marriage

Getting married is simple and easy but getting out is painful, expensive and a long process. The Philippines is the only country in the world without divorce. Annulment is available but expensive. These are common reasons why some people stay in a marriage in spite of being unhappy and loveless.  With this, House Speaker Pantaleon Alvarez offers a solution to end the suffering of both parties staying in a dysfunctional married life.  According to Alvarez, the bill for dissolution of marriage will be his advocacy in the second regular session of the 17th Congress.

With this, House Speaker Pantaleon Alvarez offers a solution to end the suffering of both parties staying in a dysfunctional married life.

According to Alvarez, the bill for dissolution of marriage will be his advocacy in the second regular session of the 17th Congress.






Under his proposal, parties will be spared from the painful process of annulment by allowing couples to jointly petition a court for the dissolution of their marriage. 

Alvarez explained this is not a divorce bill but merely seeks to free couples from an unhappy marriage.

In an instance that one of the spouses refuse the dissolution, the other spouse can still petition a court on the ground of unhappiness.

According to the house speaker, the bill won't undermine the institution of marriage and will, in fact, reinforce it because it will compel couples to work on keeping their marriages happy.






Even if the bill has not yet reached in Congress, some sectors already criticized the proposal of House speaker.

For Buhay Rep. Lito Atienza the planned bill “totally removes” the “genuine essence of marriage.” Atienza added that the bill will destroy the sanctity, respect, and value of the family.

Gabriela Party-list Rep. Emmi de Jesus also cried foul over the proposal for dissolution of marriage, pointing out that the term “unhappy” used in the bill is “very subjective.”


Archbishop Oscar Cruz, Judicial Vicar of the National Appellate Matrimonial Tribunal of the Catholic Bishops’ Conference of the Philippines (CBCP), also expressed dissent against the bill.

He then stressed that children are the first victims of failed marriages.
