Pabor kaba sa Divorce Bill?

MANILA, Philippines — INAPRUBAHAN ng House Population and Family Relations Committee nitong Martes, Marso 21 ang isang unnumbered substitute bill na nagbabalik sa divorce bilang alternatibong paraan para sa pagpapa-walang bisa ng kasal.

Unanimous na inaprubahan ang nasabing panukalang-bata matapos nakakuha ng 12-0 na boto mula sa panel.

Nakasaad sa nasabing panukalang batas na dadaan sa judicial process ang anumang divorce petition kung saan dito patutunayan ang dahilan ng divorce at kawalan ng anumang posibilidad na magkasundo pa ang mag-asawa. 

Sa kabila nito, ipinagbabawal ng panukalang batas ang quickie, notarial, email at iba pang mabilis na drive-thru divorces.

Dagdag pa nito na walang decree of absolute divorce na ibabase sa stipulation of facts o sa confession of judgment.

Maliban dito, may inilaan din na 60 araw na cooling-off period matapos inihain ang divorce petition. Sa nasabing period, gagawin ng huwes ang makakaya nito upang pagkasunduin ang magkabilang panig. 

“Spouses, especially wives, will soon have the option of getting out of an irremediably broken marriage and get a new lease on life with the approval by the House Committee on Population and Family Relations of the bill reinstituting absolute divorce in the Philippines,” pahayag ni Albay Representative Edcel Lagman, isa sa mga principal authors ng panukalang batas.

“The approval of the substitute bill on absolute divorce for eventual plenary debates assures that the country is now at the threshold of joining the universality of absolute divorce in the community of nations,” dagdag pa ni Lagman.

Inaatasan din ng divorce bill ang public prosecutor na magsagawa ng imbestigasyon upang matiyak na walang sabwatan sa pagitan ng magkabilang panig  o kung pinilit ng isang partido ang isa na maghain ng divorce petition.

Ang divorce petition, gayunpaman, ang idi-dismiss anumang oras sa panahon ng paglilitis kung sumang-ayon na magkasundo ang mga partido.

Gayundin, ang divorce decree ay maaaring mapawalang-bisa kahit na matapos ang pagpapalabas ng absolute divorce decree sa kondisyon na ang mga partido ay magpasya na magkasundo.

Para naman sa mga mapapatunayang nagkasala ng pakikipagsabwatan upang makakuha ng isang divorce decree o ng isang asawa na pumipilit sa isa na maghain ng divorce, ang panukalang batas ay nagpapataw ng limang taong pagkakakulong at malaking multa.

Sa ngayon, ang Pilipinas at Vatican na lamang ang mga bansa sa buong mundo na walang divorce law.

Divorce Bill sa Pilipinas, aprobado na sa House Committee

MANILA, Philippines — PAPUNTA na sa debate sa plenaryo ng Kongreso ang isang divorce bill matapos itong inaprobahan sa committee level.

Sa isang pahayag, inanunsyo ni Albay Representative Edcel Lagman na inaprobahan na ng Committee on Population and Family Relations ang substitute bill na ginawa ng Technical Working Group.

“Today is a momentous occasion for countless wives, who are battered and deserted, to regain their humanity, self-respect, and freedom from irredeemably failed marriages and utterly dysfunctional unions,” pahayag ni Lagman.

Ayon sa mambabatas, layunin ng panukalang batas na ibalik ang absolute divorce na una nang naisagawa sa bansa noong pre-Spanish times, American colonial period, at Japanese occupation.

Sinabi ni Lagman na pabor din sa panukala si House Speaker Lord Allan Velasco at katunayan, nagsumite ito ng mga ammendments na napapaloob na ngayon sa substitute bill na kinabibilangan ng mga sumusunod:

• provisions on court-assisted petitioners
• community-based pre-nuptial and post-matrimonial programs
• community-based women’s desks to provide assistance and support to victims of violence and abuse
• an appropriation language for the bill

Ano ang grounds para sa divorce sa ilalim ng panukalang-batas?

Paliwanag ni Lagman na ang mga grounds para sa legal separation, annulment of marriage, at nullification of marriage na naaayon sa psychological incapacity sa ilalim ng Family Code ay kasama sa mga grounds para sa absolute divorce.

Samantala, narito ang ilan pang grounds sa divorce:

• separation in fact for at least five years at the time the petition for absolute divorce is filed
• when one of the spouses undergoes a gender reassignment surgery or transitions from one sex to another
• irreconcilable marital differences as defined in the bill
• other forms of domestic or marital abuse which are also defined in the bill
• valid foreign divorce secured by either the alien or Filipino spouse

Ayon sa mambabatas na sa ngayon, Pilipinas na lamang ang nag-iisang bansa sa buong mundo na walang divorce.

“It is hard to believe that all the other countries collectively erred in instituting absolute divorce in varying degrees of liberality and limitations. An en masse blunder is beyond comprehension,” pahayag pa nito.

“An erroneous unanimity on such a crucial familial institution defies reason and experience. Obviously, the rest of the world cannot be mistaken on the universality of absolute divorce,”dagdag pa ni Lagman.

Sa ngayon, pending pa sa committee of women, children, family relations, and gender equality ng Senado ang counterpart ng divorce bill.

Karamihan sa mga Pinoy at OFWs, Suportado Umano ang Divorce Law sa 'Pinas!

After making series of consultations in and outside the country, Senator Pia Cayetano confirms that majority of Overseas Filipino Workers (OFWs) supports Divorce Law in the Philippines. 

The country is one of the very few countries worldwide where divorce is not yet passed. According to Cayetano, they visit Malaysia, Hong Kong, and Japan to know the sentiments of OFWs regarding divorce and the supports or majority for divorce is very clear. The lady senator said that even in her social media, people are always asking about the update of divorce law.

Cayetano explained that people have different stories on why they want to move on from an unhappy and failed marriage. And because some OFW women do not have the option to file a divorce, Cayetano said that they feel they are ‘legally and morally’ bound to their men.

Several bills filed in the Senate have revived debates on whether or not it's time for the Philippines to pass a divorce law.

Aside from Cayetano, Senador Risa Hontiveros also filed another version of the bill. For Hontiveros, divorce will be able to grant couples a second chance at love and happiness after a toxic marriage.

On the other hand, some senators are known to opposed divorce in the Philippines. Instead of passing a divorce bill, Senators Francis Escudero, Joel Villanueva, and Sherwin Gatchalian said the existing process of annulment under the Civil Code should be made more affordable and accessible to Filipinos.

Meanwhile, Lagman pointed out that they are working for faster and cheaper process for absolute divorce where indigent litigants will be excluded from paying filing fees and court fees.

He added the proposed bill will give authority to the courts to appoint divorce attorney or divorce lawyers from Integrated Bar of the Philippines or from other legal association to lessen the fees.

"DIVORCE BILL" HB 2380: WILL THERE BE A DIVORCE LAW IN THE PHILIPPINES SOON?

The Divorce Bill has been filed again in the Congress after failing to have it deliberated in the previous four Congress years. The Philippines is the only country in the world without a Divorce Law aside from the Vatican. The difficult process of legal separation and tremendous amount of money to be incurred to find divorce attorney or family attorney has been frustrating to many others.

And so for the 5th time, the Divorce Bill has been filed at the Congress in a hope that this will turn into law. Gabriela Women's Party Representative Emmi de Jesus and Arlene Brosas filed the landmark bill.  

GROUNDS FOR DIVORCE ACCORDING 
TO HOUSE BILL 2380

• The petitioner has been separated de facto from his or her spouse for at least 5 years at the time of the filing of the petition, and reconciliation is “highly improbable”
• The petitioner has been legally separated from the spouse for at least two years at the time of the filing, and reconciliation is “highly improbable”
• When any of the accepted grounds for legal separation “has caused the irreparable breakdown” of the marriage
• When one or both spouses are psychologically incapacitated to comply with the essential marital obligations
• When the spouses suffer from irreconcilable differences that “have caused the irreparable breakdown" of the marriage

Also the following grounds of the Article 55 of the Family Code will also be the basis of the divorce.
