HOUSE BILL NO. 3576 MANDATORY TO SEND SUPPORT TO HIS OR HER LEGAL DEPENDENTS AS REQUIRED BY EXISTING LAWS

Ang kinatawan ng OFW Family Partylist na si Rep Roy V. Seneres ay nagfile ng House Bill 3576 na nagbibigay sa mga Ambassadors, Consul Generals, Charge d' Affairs ng karapatan para direktahan ang isang OFW na magpadala ng parte ng kanyang kinikita sa kanyang mga mga legal na dependents na naiwan sa Pilipinas dahil kung hindi ay posible itong maharang at hindi makapagrenew ng passport.

Ayun kay Seneres ang hindi pagpapadala ay likas na sa mga land based na OFWs hindi kagaya ng mga seaman na nagtratrabaho sa ibang bansa, at ang mga land based ay hindi sakop ng batas na NIREREQUIRE sa kanila na magremit ng kanilang sahod sa mga pamilya sa Pinas. 
Sa ilalim ng HB 3576, ang mga OFW ay mandatory na sundin ang batas na magpadala ng materyal, pinansiyal at moral na suporta sa mga miyembro ng kanilang pamilya sa Pilipinas habang nasa abroad. 


Ang bill ay nagbibigay ng karapatan sa Department of Foreign Affairs o DFA na kailangan ang isang OFW ay magbigay ng PROOF OF REMITTANCE  bilang requirement sa pagrerenew ng passport. Sa proposal na batas, kailangan rin ang mga kumpirmadong bank remittance, o resibo ng padala o Sworn Statement mula sa dependent na ang suporta ay binibigay nga at naibibigay nga sa kanila.

AN ACT AUTHORIZING AMBASSADORS, CONSUL GENERALS, CHIEFS OF MISSIONS OR CHARGE D’ AFFAIRS TO ORDER AND DIRECT AN OVERSEAS FILIPINO WORKER (OFW) TO SEND SUPPORT TO HIS OR HER LEGAL DEPENDENTS AS REQUIRED BY EXISTING LAWS

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Remittance of Foreign Exchange Earnings. – Overseas Filipino Workers (OFWs), whether sea-based or land-based are required to remit regularly a portion of their foreign exchange earnings to their family or legal dependent recipient in the Philippines through the Philippine banking system or any authorized credit unions, money transfer operators or through the postal mail. Private employment agencies and other entities authorized by the Philippine Overseas Employment Administration (POEA) to recruit Filipino workers for overseas employment are similarly required to assist OFWs in the remittance of their foreign exchange earnings as provided for in this Act.

SEC. 2. Obligations and Duties of Overseas Filipino Workers. – It shall be the obligation and duty of every OFW to continue to observe and respect the laws, customs, traditions and practices of the Philippines wherever they may be. It shall also be the obligation and duty of every OFW to provide material or financial and moral support to one’s family or dependent in the Philippines during the period of overseas employment.

SEC. 3. Designated Recipient of Support. –The designated recipient of support of the OFW shall be one of those entitled to support from the OFW under existing laws. The designation of a recipient or dependent shall be in accordance with the enumeration in Article 195 of Executive Order No. 209, otherwise known as the “Family Code of the Philippines” which pertains to those who are obliged to support each other.

SEC. 4. Proof of Remittance. – For purposes of this Act, proof of compliance with the mandatory remittance requirement as mentioned in Section 1 hereof, may consist of any of the following documents showing that the OFW had in fact effected the aforesaid remittance to his or her designated recipient or dependent:
a) Confirmed bank (foreign) remittance receipt;
b) Receipt of International Postal Money Order;
c)  A Sworn Statement from the dependent that said support has already been satisfied and/or settled;

SEC. 5. Ambassadors, Consul Generals, Chiefs of Mission or Charge d’ Affairs Authorized to Withhold Renewal or Approval of Passport. – Passports issued to OFWs may be renewed by the Department of Foreign Affairs (DFA) upon submission of the usual requirements and presentation of documentary proof of compliance to the remittance requirement provided for in this Act.  Upon receipt of a duly notarized Complaint for Support from any OFW dependent, which sworn statement duly authenticated by the Mayor or Governor of the dependent’s place of residence, Ambassadors, Consul Generals, Chiefs of Mission or Charge d’ Affairs are authorized to withhold the renewal or approval of the passport of an erring OFW unless proof of compliance of the remittance requirement of his financial support is submitted.

SEC. 6. Implementing Rules and Regulations. – Within sixty (60) days from the effectivity of this Act, the Secretary of the Department of Foreign Affairs (DFA) in consultation with the Secretary of the Department of Labor and Employment (DOLE), the Administrator of the Philippine Overseas Employment Administration (POEA), the Administrator of the Overseas Workers Welfare Administration (OWWA), shall promulgate the necessary rules and regulations for the effective implementation of this Act.
 SEC. 7. Non-impairment Clause. – Nothing in this Act shall be construed to diminish, impair or repeal the rights granted to OFWs under existing laws, rules and regulations.

SEC. 8.  Separability Clause. – If any provision or part of this Act is declared unconstitutional or invalid, the remaining parts or provisions not affected shall remain in full force and effect.

SEC. 9. Repealing Clause. – All laws, decrees, ordinances, rules and regulations and other issuances or parts thereof, which are inconsistent with this Act, are hereby repealed or modified accordingly.

SEC. 10.  Effectivity Clause. - This Act shall take effect fifteen (15) days after publication in the Official Gazette or in two (2) national newspapers of general circulation.

Ay HINDI talaga nag IISIP kung ang batas na ginagawa niya ay angkop para sa lahat ng OFWs,Patawad!!!! hindi kailangan na pilitin ang isang OFWs na magpadala sa Pilipinas,alam niya(OFW) kung NAKAKABUTI o HINDI ang mag padala ,para sa kaalaman ng lahat ang OFWs ay isang BAGONG PULUBI!!!!Para sa kaalaman ng lahat at lalo na sayo OFW Family Partylist Rep.Roy V.Seneres na walang ALAM kung ano buhay meron ( bilang OFWs ) = hindi lahat maganda ang buhay bilang OFW,kumakain ng tira tira,minsa wala pa nga ang iba ,hindi sapat na pagkain,hindi maayos ang kalagayan sa mga amo,pressure ,stress sa amo at pamilya sa Pilipinas.Malaman ng pamilya sa Pinas KUNG ang isang OFW PAG NAMATAY AY lubog pala sa UTANG !!!!!!Sa batas na'to tila AYAW NINYO na MAKAPAG-IPON ng DOLLARS ang mga OFWs ===Unti unti na po kami na totoo na hindi lahat ng earnings namin ipapadala sa WAG kami pangunahan sa MGA PLANO namin!!!!

Walang nagsangayon sa FB ang Bill na ito. Kundi mga nag gagalaiting galit ng mga OFW. Check mo nalang ang FB mo. Isang tanong naging OFW kaba? Napag daanan mo ba ang mga napag dadaang suliranin ng mga OFW? Isang pahirap lang ito sa kanila. Sa pag kuha nalang ng OCE ng isang OFW. Ubos na siya ng isang araw diyan. Tapus ito mga chechebureche may mga notary kapang nalalaman. Dagdag pasakit lang ito. Mag isip ka naman ng iba. Ang daming mga nakakulong na mga OFW, yon ang mga tignan mo, kung layunin mo ang makatumulong at hinde ang dagdagan pa ang pahirap sa mga OFW alam ng isang OFW ang sulirain niya huwag mo nga panunahan hinde BOBO ang OFW na hinde niya alam ang sulirain niya.

sir kng gusto mong makilala o ma pansin ng pamilya ng mga ofw wag sa ganitong para-an,ang unahin nyo yung ma bigyan ng karapatan,taas ng sahod, wag abusohin ang OFW para ma pa buti ang trabaho at makapadala ng sapat sa pamilya,wag yung dagdag pahirap pa?recibo,sworn statement etc.pahirap yan...sir try nyo mg OFW isang beses lng para malaman nyo kng paano?mg resign ka muna dyan..

Napaisip naman ako .. binoto ko pa naman yan party list n yan tpos pahirap lng pa ang mga ipapatupad na batas ng party list n yan.. sana nag focus k n lng sana kung paano mabawasan ung bayaring ng ofw bago umalis sa pinas. Tatandaan kitang party list ka! hndng hnd kita iboboto!

Hindi ka ba nag iisip sir? Putang ina naman ni hindi mo yata alam ang hirap ng maging isang OFW. Mandohan mo pa kaming magpadala... Akala mo naman di namin alam ang obligasyon namin... Hirap na hirap na kami dito papahirapan mo pa talaga kami ano? Tang ina mo... Mag pasa ka muna ng batas na mapadali ang pagkuha ng passport bago kung ano ano ang iniisip mo... Bwisit... Nakakadismaya...

What the f*@$ are you thinking seneres. What in the hell were you thinking about when you made this bill? Were you able to do some research or surveyed families of OFWs if and what their concerns are about, how, WE OFWS' are sending money? Like how often and how much we are sending? Why would you do that? Why would you in the first place intervene in our personal lives. Yes our personal lives in terms of our responsibilities to our familiesl/dependents. You have NO RIGHT to question that NOR make a bill out of it. Why are you the one hundreds of thousands of miles away from home from family. NO!!! When we decided to work abroad we if not all have this in mind. WE if not all are going to work away from home to be able to support our family better and save more money. So it depends individually on us OFWS' if were going to remit on a monthly basis, or whatsoever bec. Not all of us OFWS' are supporting our own families. Some are single so were just saving money, some if not most of us are married and have a whole family to support and the amount of remittance we send depends on the amount of salary we get here abroad. Also OFWS' have plans of their own that maybe includes not remitting monthly or for whatever reason. And if there is anybody/anyone who has the right to demand remittance to OFWS', it should be our families and or dependants not YOU. you may be representing us there in our government but this one goes dont the drain MR.!!! And dont compare us with seafarer.. were not in the same exact situation as them.
So i am an OFW, single. My salary isnt big and my mom is able to support her finances so im not obliged to send her money every month if so i send it together with my sister who is also single to save up on the charge. So how does your bill go about that? And does the bill specified how many months of remittance receipt is required upon renewal of passport and or acquaring of OEC and the other requirements needed before coming back from vacation. I didnt noticed it in the sections.
I hope that this bill will be abolished, removed because its not making us happy.

PUTANG INANG BATAS NA TO....lalo nyo kaming pinahirapan...pati nga pagkuha ng OEC pinahirapan nyo na kami,kailangan pang mag bayad ng pag-ibig fund bago maka kuha ng OEC kahit hindi membro....at kung padala ng padala kami sa pinas,anong maiipon namin dito...nag abroad nga para makaipon at umangat ang buhay,,,at sa pinas naman pag makatanggap ng pera one day millioner,,ayaw na magtrabaho kasi may pera,shoping agad,sinusugal pa ang pera namin,at inuman kasama ang barkada samantalang kami dito minsan hindi kumakain para lang makaipon....ANG SARAP MONG SUNTUKIN GAGO KA PARA MATAUHAN KA....inaabuso nyo na kami...ALAM NAMIN ANG RESPONSIBILIDAD NAMIN WAG MO KAMING UNAHAN AT ALAM DIN NAMIN KUNG MAGKANO ANG AMING IPAPADALA....maraming mga pilipno ditong nakakulong at inaabuso ng mga amo...yan ang pagkunan mo ng pansin......BWESET TONG BATAS NATO....kung wala kang ibang maisip umopu ka lang dyan sa pwesto at maghintay kung kailan ang sahod mo....ikaw kaya dito sa kalagayan namin....GAGO KA....putang ina mo....paano na yan ang asawa ko sa pinas nag luko pa sumama sa lalaki,,ANO MAGPAPADALA PA BA AKO NG PERA SA KANYA...GAGO KA....PUTANG INA MO...

Saan ka ba talaga brod. sa amin ka ba. isip-isip din ng kaunti pag may time. sa pag renew palang ng passport abot na ng buwan. yan pa ang idag-dag mo panu na yong mga "ETM" (Every three months) ang sahod di di na makag renew ng passport.

This bill is absolutely ridiculous..this is an absolute violation of rights. Of course it is their responsibility and that's about it but making them and setting up a bill like “May mga natatanggap ako na reklamo sa mga asawa na pinabayaan ng mister sa ibang bansa,” Seneres said. This is absurd statement from the author. This is the will of an individual whether they'll remit to their spouses/family or not. Its the family problem not yours but making them to comply with the bill is unconstitutional. The House Bill 3576 is a dictatorship.

The House Bill 3576, is only for the sentiment to the spouses who unfortunately were not receiving support from their spouses abroad, that's sad I must say. But its the OFW's prerogative and the bottom line is its their money. For cry not loud, let them fucken decide how and what to do with their money. They work their shit hard to earn it. Seneres if you are the author of this Bill 3576 you must be out of your mind! ! ! ! you got it? And also, I was wondering where did you get your education?

Hi po...san po pwedeng pumuntang government agencies dito sa pinas para sa sustentong dapat na makuha ng 2 bata na iniwan ng isang ama na nagta trabaho mahigit sampung taon nasa new zealand na ni minsan ay hindi nag bigay.kahit manlang sa 2 anak.

Mag-isip isip naman ang nag-post ng bill na to. Paano mo papadalhan ng remittance ang asawa mong nambababae sa Pinas? yan na nga ang sakripisyo ng isang OFW, para guminhawa ang pamilya. One day millionaire silang lahat. Pagkakuha ng perang padala, diretso na sa sabuingan, inuman at babae. Samantalang ang OFW dito na nagsasakripisyo, halos hindi na umuuwi ng bahay sa kaka-overtime, kakaraket para kumita ng extra at halos kumakain na l;ang ng pangat (pangatlong init na lang).

Mayroon akong nakilala na housemaid, 1,000 SAR lang ang sahod niya kada-buwan, minsan sa isang araw lang sila pinapakain ng amo (alas tres ng hapon), kung minsan panis pa ang ibinibigay sa kanila. Sa tuwing tinatawagan ko siya para kumustahin, umiiyak sa akin sa telepono dahil hilo na daw siya sa gutom. Buwan buwan, ipinagkakatiwala niya sa akin ang remittance para sa kanyang pamilya sa Pinas na akin namang ipinapadala. Nang minsan akong namasyal sa kanyang pamilya sa Pinas, nakita ko ang totoong sitwasyon ng pamilya, walang trabaho ang kanyang mga anak, isang mananabong at tambay sa bahay. Ang kanilang ina na idad ay 64 years old na hanggang ngayon ay OFW pa din dahil inaalala niya ang kanyang mga anak... Ngayon, Mr. Seneres, pag-isipan mong mabuti ang batas na lalong magpapahirap sa mga OFW. Hindi lahat ng OFW ay malalaki ang sahod at may ginhawang inaasahan. Gaya ng aking kaibigan, ipinapadala niyang lahat ang kanyang sahod sa kanyang anak dahil inaakala niyang malaki ang pangangailangan. Pero ano ang aking nakita? istambay na nga, sabungero pa. Maawa ka sa mga OFW. Mas magandang batas na ipanukala mo, ang mabigyan ng security ang mga OFW na inaabuso ng amo. Ang mabigyan ng life insurance ang bawat OFW na umaabot ang 60 or senior citizen. Ang PhilHealth na binabayaran taun-taon at tumataas pa ang bayarin, pero kapag hindi nabayaran ng minsan, cancelled agad ang philHealth? Bakit hindi baguhin ang protocol? Mr. Seneres, gumawa ka ng mas matinong batas at huwag mo kaming pahirapan. Madami kang magiging haters at baka pati personal mong buhay, halukayin. ikaw din.
