Guidelines on How to File for Child Support if You're a Single Parent

One of the rights and obligation between husband and wife,
as stated in the Family Code of the Philippines, is they’re “obliged to live together, observe mutual love, respect and fidelity, and render mutual help and support.” But due to modernization, Filipino culture such as close family ties
and conservative marriages tend to be forgotten and taken for granted. Thus, this produces many unfaithful spouses leading to “broken” families.
advertisement

Unfortunately, the single parent, who is mostly mothers, will
be forced to work for their children. However, a single parent is usually having difficult time to support their children due to some limitations since they become helpless in taking care of their children (which should be done by both parents). Hence, circumstances like these results to filing for support from the fathers of their kids by the single parent.

(Courtesy credfit to the owner of the photo)

It is in the law that parents have the responsibility for
the welfare of their children. In the Family Code of the Philippines, it is stated that “When one of the spouses neglects his or her duties to the conjugal union or commit acts which tend to danger, dishonor or injury to the other or
to the family, the aggrieved party may apply to the court for relief.” The acts include economic abuse in which filing for support takes place. Thus, these measures will provide penalties for those who break the law.

Here, we provided some guidelines on how to file for child
support:

1. Be prepared for payment for court fees. Not all
those who file and ask for support are able to pay for court fees. Hence, they will be given help from Public Attorney’s Office, Department of Justice or the Department of Social Welfare and Development, depending on the case.

2. Protection Order is issued. In some cases, this is done for protecting the aggrieved party. Automatically, the children will be in the custody of the mother with a privilege of support.

3. The case shall be filed in the Regional Trial Court. This will function as Family Courts for hearing cases.

4. Support is applied for legitimate and even illegitimate children by fathers depending on their capacity to provide. As stated in the law, “Support comprises everything indispensable for sustenance, dwelling, clothing, medical attendance, education and transportation, in keeping with the financial capacity of the family.”

5. The woman or the mother of the child is the one who will file for the support of the child. Inevitably, children below seven (7) years of age are in the custody of the mother.

6. Giving support from the father is obligatory notwithstanding of the marriage status. Children are eligible for sustenance from their parents.

Sadly, filing for support is like embarking on a rough
journey. It is saddening that the children who are at an early age are affected by situations like this--- which in the first place should be living in harmony with both of their parents at home. Obviously, it is not always that way.

Hence, the best way to at least help them is through filing for adequate support with these guidelines.

Credit Card - How To Apply And Get Approved

There are many reason why a person would want a credit card. Primarily, we want credit card, for convenience. In our time right now, who would risk carrying money and being robbed. And if you are someone who travels out of country most of the time, you cannot deny that credit card is your best friend. Credit card is also one of the easiest way to shop online. You don't have to worry about paying something on a different currency, because that is one of the convenience of having credit card.

You can use it in times of financial emergency. It is the easiest way to pay when you are shopping online, for example when purchasing plane tickets. You can get reward points or rebates and you can save a lot specially if you intend to pay-off what you spent before the due date on your credit card statement. And there are credit card offers too that you can enjoy, like discounts and other financing offers and more.

However if right now,  you are among those who had been trying to apply for credit card but you were never approved. Do not lose hope.

One of the things credit card companies look at before approving any credit card application is credit history. But credit history always starts with nothing, right?  How do you build credit history unless some company gave you credit.  And of course no one will give you credit if you have no capacity to pay.

So, lets talk about your capacity to pay.  When we moved back to Philippines after living overseas for more than 10 years, it took several attempts online to apply for one. And those attempts were all denied.

HOW DO YOU GET YOUR FIRST CREDIT CARD APPROVED?

advertisementadvertisement

Because we have no credit history, and no job at the moment, the chance to get approved is fairly low.

So we went to our bank one day, and while talking to the financial manager. She brought up the topic about credit card, and asked us if we would want to apply for one.

It turned out, that if you have bank account, you can actually use it to get approved on your application.

We filled up the form given by the bank manager. And depending on  how much line of credit do you want, the bank will place hold on your savings or bank account. To be clear, she asked us to sign a waiver assigning certain amount for our credit card. It was like an authorization to hold a certain amount on our bank account. This amount will serve as guarantee for the settlement of credit card.

After few days, we received notification that our application for credit card has been approved, it was delivered  within two weeks.

WHAT IF YOU DON'T WANT TO ASSIGN MONEY FROM YOUR BANK ACCOUNT?

Right now, without work and credit history in Philippines, this is the surest and fastest way you could secure a credit card and get approved in few days. Once you have established your credit history with a good credit reputation, within 6 months you may try to apply again. By then, you wouldn't need a hold on your bank account just to get approved.

Since we have not asked and tried applying on all credit card companies, we encourage you to ask your bank and try if possible to get credit card without assigning any amount from your bank or savings account.
