How And Where To File Correction or Change Of Name (Birth Certificate and Marriage Certificate)




There are instances when documents such as birth certificates or marriage contract contain typographical errors. For example a person who is applying for a work found out that the name in the NSO birth certificate is misspelled and different from the name he or she has been using. AN ACT AUTHORIZING THE CITY OR MUNICIPAL CIVIL REGISTRAR OR THE CONSUL GENERAL TO CORRECT A CLERICAL OR TYPOGRAPHICAL ERROR IN AN ENTRY AND/OR CHANGE OF FIRST NAME OR NICKNAME IN THE CIVIL REGISTER WITHOUT NEED OF A JUDICIAL ORDER, AMENDING FOR THIS PURPOSE ARTICLES 376 AND 412 OF THE CIVIL CODE OF THE PHILIPPINES.

Under this  law, the city or municipal registrar may correct clerical or typographical errors in name, birth date,  or gender without a court order.

Types of correction needed:



Correction in Birth Certificate

1. Wrong spelling of first name, middle name or surname-  The wrongly spelled first name, middle name or surname in the birth certificate should be corrected by filing a petition for correction of clerical error under the provisions of Republic Act 9048.
Where to File: 
If born in the Philippines
  • The petition shall be filed with the local civil registry office of the city or municipality where the birth is registered. (Filing Fee according to PSA or Phil. Statistics Office P 1,000)
  • When the petitioner had already migrated to another place within the Philippines and it would not be practical for such party to appear in person with the civil registrar of the place of birth, the petition may be filed with the civil registry office where he/she is currently residing.
If born abroad
  • For Saudi Arabia check here

    2. First name used is different from the first name entered in the birth certificate- If the first name used is different from what is entered in the birth certificate, the name in birth certificate has to be changed. 
    Change of first names like Ma. to Maria should be corrected by filing a petition for change of first name under the provisions of R.A. 9048.

    Where to File: 
    If born in the Philippines
    • The petition shall be filed with the local civil registry office of the city or municipality where the birth is registered. (Filing fee P 3,000)
    • When the petitioner had already migrated to another place within the Philippines and it would not be practical for such party to appear in person with the civil registrar of the place of birth, the petition may be filed with the civil registry office where he/she is currently residing. 
    If born abroad

    • If born abroad, with the Philippine Consulate where the birth was reported. (Filing fee $150)

    Supporting documents needed
    3. For errors on birth date or genderThe person may apply for change of entry in the birth certificate in the Office of the City / Municipal Local Civil Registrar of the place where the  birth was recorded pursuant to R.A. No. 10172.

    Documents needed: 
    6.1. Earliest school record or earliest school documents
    6.2. Medical records; 
    6.3. Baptismal certificate and other documents issued by religious authorities; 
    6.4. A clearance or a certification that the owner of the document has no pending administrative, civil or criminal case, or no criminal record, which shall be obtained from the following:
    6.4.1. Employer, if employed;
    6.4.2. National Bureau of Investigation; and 6.4.3. Philippine National Police.
    6.4.5 The petition for the correction of sex and day and/or month in the date of birth shall include the affidavit of publication from the publisher and a copy of the newspaper clipping; and 
    6.6. In case of correction of sex, the petition shall be supported with a medical certification issued by an accredited government physician that the petitioner has not undergone sex change or sex transplant.

    Correction in Marriage Certificate:

    1. Wrong spelling on the name of bride and/or groom- The first name of the bride and/or groom entered in the Certificate of Marriage (COM) is different from the first name as appearing in the registered Certificate of Live Birth (COLB). For example: the first name in the COLB is "Maria Ana" but in the COM is "Ma. Anna, the correct first name used is "Maria Ana".

    How to correct
    A petition for the correction of entry/ies through RA 9048 is to be filed at the Local Civil Registry Office (LCRO) where the COM was registered. 
    Fees
    Under RA 9048 law, the City/Municipal Civil Registrar (C/MCR) or District/Circuit Registrar (C/DR) shall collect a fee of P 1,000.00 for filing a petition for correction of entries.
